Misdemeanor Crimes of Domestic Violence (MCDV)
If your Firearm Owner's Identification (FOID) Card was revoked or your FOID application was denied because you have an Illinois conviction for Domestic Battery or MCDV as defined by 18 U.S.C. 921(a)(33), you are federally prohibited from possessing firearms pursuant to 18 U.S.C. 922(g)(9). Relief for these convictions must be sought through the Circuit Court in the county of your residence.
For any out of state convictions for Domestic Battery or MCDV as defined by 18 U.S.C. 921(a)(33), you are federally prohibited from possessing firearms pursuant to 18 U.S.C. 922(g)(9). Relief for these convictions must be sought through the state where your conviction occurred.
Once you have obtained court relief or had the conviction vacated or expunged, you should forward the court order to ISP.FRCU@Illinois.gov along with your name, date of birth, and FOID number and FDR if applicable and not already submitted. Upon receipt of the required documentation, your application will be reviewed and processed. Submission of the required documents does not guarantee approval of a FOID card; however, it is required to begin the review process.
Please Note: If you obtain an order from a court granting you relief under 10(c) of the FOID Act and directing the Department to issue you a FOID Card that does not include an order of expungement or otherwise vacating your conviction, the issuance of a FOID Card under these circumstances does not grant you immunity from arrest or prosecution for violations of federal law, including the Gun Control Act of 1968, 18 U.S.C. § 922. It is incumbent upon you to seek any necessary declaration from the federal government regarding your rights and prohibitions under federal law.
