Court-ordered relief required
If your Firearm Owner's Identification (FOID) Card was revoked or your FOID application was denied because you were convicted of any of the following, you are not permitted to obtain a FOID Card unless you receive relief from the Circuit Court in the county of your residence or court in the state of conviction for out of state convictions:
- a forcible felony, (see 720 ILCS 5/2-8 for definition of a forcible felony)
- aggravated stalking,
- domestic battery,
- any violation of the Illinois Controlled Substances Act that is Classified as a Class 2 or greater felony,
- a violation of the Methamphetamine Control and Community Protection Act that is classified as a Class 2 or greater felony, or
- a violation of the Cannabis Control Act that is classified as a Class 2 or greater felony,
- a felony violation of Article 24 of the Criminal Code of 1961 or the Criminal Code of 2012, or
- any adjudication as a delinquent minor for the commission of an offense that if committed by an adult would be a felony.
- If your FOID Card was revoked, you are required to surrender your FOID Card and a completed Firearm Disposition Record, documenting the transfer of all firearms in your possession. This should have been completed with 48 hours of the revocation consistent with 430 ILCS 65/9.5. If you have not completed this step, you may obtain a copy of the required form below.
Please Note: Once you have obtained court relief or had the conviction vacated or expunged, you should forward the court order to ISP.FRCU@Illinois.gov along with your name, date of birth, and FOID number and FDR if applicable and not already submitted. Upon receipt of the required documentation, your application will be reviewed and processed. Submission of the required documents does not guarantee approval of a FOID card; however, it is required to begin the review process.
