Mental Health Admission/ Clear and Present Danger
If your Firearm Owner's Identification (FOID) Card was revoked or your FOID application denied because less than five years ago you were a patient of a mental health facility or met the definition of clear and present danger as provided in Section 1.1 of the FOID Act (430 ILCS 65/1.1), your appeal will be initiated when you submit the Request for FOID Investigation, Relief and Reinstatement of Firearm Rights and FDR if applicable and not already submitted. Although these appeals must be initiated with the Firearms Record Challenge Unit (FRCU), they are under the jurisdiction of the FOID Card Review Board (FCRB) which is a separate entity from the FRCU; therefore, the FRCU will be unable to provide any updates or time frames for FCRB. Once the appeal is initiated, future correspondence will come from the FCRB.
If your Firearm Owner's Identification (FOID) Card was revoked or your FOID application denied because more than five years ago you were a patient of a mental health facility or met the definition of clear and present danger as provided in Section 1.1 of the FOID Act (430 ILCS 65/1.1), you are not permitted to obtain a FOID Card unless your firearms rights are restored. To restore your firearms rights, you must submit a Firearm Disposition Record, Request for FOID Investigation Relief Reinstatement Firearms Rights and receive a mental health evaluation by an Illinois licensed physician, clinical psychologist, or qualified examiner as those terms are defined in the Mental Health and Developmental Disabilities Code (405 ILCS 5/1-122), and a certification that you are not a clear and present danger to yourself or others.
If your physician or clinical psychologist reviews the documentation regarding your prior hospitalization, assesses your current mental health status, and agrees you meet the conditions set forth in the form, they can complete the Mental Health Certification form. Upon receipt of a properly completed Mental Health Certification form, your application will be reviewed, and you will be notified once the decision has been made or if additional information is needed. Please note, this form must be returned directly to the Illinois State Police by the examiner and may not be sent by you. Submission of the required documents does not guarantee the granting of an appeal or relief; however, it is required to begin the review process.
